TERMS OF SERVICE

CSUCİTEO — In accordance with UK Consumer Rights Act 2015, Consumer Contracts Regulations 2013 & UK GDPR

OVERVIEW

Welcome to CSUCİTEO! The terms "we", "us" and "our" refer to CSUCİTEO. We operate this store and website, including all related information, content, features, tools, products and services, to provide you with a personal shopping experience ("Services"). CSUCİTEO is powered by Shopify, which enables us to provide the Services to you.

The following terms and conditions, together with all policies referenced herein (collectively, "Terms of Service" or "Terms"), set out your rights and obligations when using our Services.

These Terms of Service contain important information regarding your legal rights, including warranty disclaimers and limitations of liability, and should be read carefully.

By visiting, using or interacting with our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not accept these Terms of Service or our Privacy Policy, you must not use or access our Services.

SECTION 1 — ACCESS & ACCOUNT

By accepting these Terms of Service, you confirm that you are of legal age in your country of residence and that you give us permission to allow any minors in your care to use the Services through devices you own, purchase or manage.

To use our Services — including browsing or accessing our online store or purchasing any products or services — you may be required to provide certain information, such as your e-mail address, billing, payment and delivery details. You warrant and represent that all information you provide is accurate, current and complete, and that you hold all necessary rights to provide such information.

You accept that you are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign or licence your account to any other person.

SECTION 2 — OUR PRODUCTS

We make every effort to accurately represent our products and services on our online store. However, colours or product appearance may differ from what is displayed on your screen, depending on the type of device you use and its settings and configuration.

We do not guarantee that the appearance or quality of any product or service you purchase will meet your expectations or will be exactly as shown or described on our online store.

Product descriptions are subject to change at any time without prior notice, at our sole discretion. We reserve the right to withdraw any product from sale at any time and may limit the quantities of products we offer on a case-by-case basis, by person, geographical region or jurisdiction.

⚖️ Your UK Consumer Rights: Under the Consumer Rights Act 2015, all products sold must be of satisfactory quality, fit for purpose and as described. Nothing in these Terms affects your statutory rights as a consumer under UK law.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase. CSUCİTEO reserves the right, at its sole discretion, to accept or refuse any order for any reason. Your order shall not be deemed accepted until CSUCİTEO issues an acceptance confirmation. We must receive and process your payment before your order can be accepted. Please review your order carefully before submitting it. Once an order has been accepted, CSUCİTEO may not be able to accommodate cancellation requests.

If we are unable to accept, amend or must cancel your order, we will endeavour to notify you using the e-mail address, billing address and/or telephone number provided at the time of ordering.

⚖️ Your UK Consumer Rights: Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods without giving any reason (cooling-off period). Please refer to our Returns Policy [LINK] for full details.

Your purchases are subject to return or exchange only in accordance with our Returns Policy [LINK].

You warrant and represent that your purchases are for your personal or household use only and are not for commercial resale or export.

SECTION 4 — PRICES & BILLING

Prices, discounts and promotions are subject to change without prior notice. The price charged for a product or service shall be the price in effect at the time the order is placed and will be confirmed in your order confirmation e-mail.

Unless expressly stated otherwise, all prices shown are inclusive of VAT where applicable, in accordance with UK law. Delivery charges, transaction fees, customs duties or import charges are not included unless expressly stated.

Prices displayed on our online store may differ from those offered in physical stores or in online or other stores operated by third parties.

We may from time to time offer promotions on the Services that are governed by separate terms and conditions. In the event of any conflict between the terms of a promotion and these Terms, the promotional terms shall prevail.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made through our store. You agree to promptly update your account information, including your e-mail address, credit card numbers and expiry dates, so that we can complete your transactions and contact you as required.

You warrant and represent that: (i) the credit card information you provide is accurate, complete and correct; (ii) you are authorised to use the credit card for the purchase; (iii) charges incurred by you will be honoured by your credit card company; and (iv) you will pay the charges incurred by you at the stated prices, including all delivery and transaction charges and any applicable taxes.

SECTION 5 — SHIPPING & DELIVERY

We cannot be held responsible for shipping and delivery delays. All delivery timeframes are estimates only and are not guaranteed. We cannot be held liable for delays caused by courier companies, customs processes or circumstances beyond our control. Once goods have been transferred to the courier, title and risk of loss passes to you.

⚖️ Your UK Consumer Rights: Under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013, if no delivery date is agreed, goods must be delivered within 30 days. If we are unable to deliver within this timeframe, you have the right to cancel your order and receive a full refund.

SECTION 6 — INTELLECTUAL PROPERTY

All trade marks, brands, text, images, visuals, graphics, product reviews, video and audio content, including but not limited to the design, selection and arrangement of our Services, are owned by CSUCİTEO, its affiliates or its licensors and are protected by UK and international patent, copyright and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any materials from the Services without our prior written consent.

Nothing in these Terms shall be construed as granting you any licence or other right under the patent, trade mark, copyright or other intellectual property rights of CSUCİTEO, Shopify or any third party, except as expressly set out herein. Unauthorised use of the Services may constitute an infringement of UK intellectual property legislation. All rights not expressly granted herein are reserved by CSUCİTEO.

SECTION 7 — OPTIONAL TOOLS

We may provide you with access to third-party tools over which we have no monitoring, control or input. You acknowledge and agree that we provide access to such tools on an "as is" and "as available" basis, without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the Services is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms under which such tools are provided by the relevant third-party provider(s).

SECTION 8 — THIRD-PARTY LINKS

Our Services may contain materials and hyperlinks to websites provided or operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites. We shall have no liability for any third-party materials or websites, or for any other materials, products or services of third parties.

If you choose to leave our Services to access third-party websites, you do so entirely at your own risk. Please carefully review the policies and practices of any third party before engaging in any transactions with them.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

[NOTICE TO MERCHANT: This section accurately describes the relationship between Shopify and your store and should not be removed or amended.]

CSUCİTEO is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases made through our store are conducted directly with CSUCİTEO. By using the Services, you acknowledge and agree that Shopify shall have no liability whatsoever arising from or in connection with sales between you and CSUCİTEO, including any injury, damage or loss arising from purchased products or services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with CSUCİTEO.

SECTION 10 — PRIVACY POLICY

All personal information collected through the Services is subject to our Privacy Policy, which is available at https://csuciteo.com/pages/gizlilik-politikasi and is governed by the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Some personal information may also be subject to Shopify's Privacy Policy.

By using the Services, you confirm that you have read and understood these privacy policies. As the Services are hosted by Shopify, Shopify may collect and process personal information relating to your access and use of the Services in order to provide and improve the Services. Information you transmit to the Services may be passed to and shared with Shopify and third parties located in countries other than your country of residence.

⚖️ Your UK Rights: You have the right to access, rectify, erase and port your personal data, and to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk if you believe your data protection rights have been breached.

SECTION 11 — FEEDBACK

If you submit, upload, post, e-mail or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including commercial use.

You further warrant and represent that: (i) you own or hold all necessary rights in respect of the Feedback; (ii) you have disclosed any compensation or incentive received in connection with submitting the Feedback; and (iii) your Feedback will comply with these Terms.

We are under no obligation to: (1) maintain any Feedback in confidence; (2) pay compensation for any Feedback; or (3) respond to any Feedback.

We may, at our sole discretion, monitor, edit or remove Feedback that we determine to be unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes any party's intellectual property rights or these Terms of Service, though we are under no obligation to do so.

SECTION 12 — ERRORS, INACCURACIES & OMISSIONS

From time to time, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, delivery charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, to change or update information, and to cancel orders where any information is inaccurate, without prior notice (including after you have submitted your order).

SECTION 13 — PROHIBITED USES

You may access and use the Services only for lawful purposes. You must not access or use the Services, directly or indirectly, for the purposes of: (a) any unlawful or malicious activity; (b) violating any international, UK, EU or local regulation, rule, law or ordinance; (c) infringing our intellectual property rights or those of others; (d) harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating or discriminating against any person; (e) submitting false or misleading information; (f) uploading or transmitting viruses or any other malicious code; (g) collecting or tracking personal information of others; (h) engaging in spam, phishing, or scraping; or (i) interfering with or circumventing the security features of the Services or the Internet.

We reserve the right to suspend, disable or terminate your account at any time if we determine that you have breached any provision of these Terms.

SECTION 14 — TERMINATION

We may terminate this agreement or your access to the Services (or any part thereof) at any time, without notice, at our sole discretion. You shall remain liable for all amounts due up to and including the date of termination.

The following sections shall survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy and any other provisions that by their nature should survive termination.

SECTION 15 — DISCLAIMER OF WARRANTIES

⚖️ Important Notice for UK Consumers: Nothing in this section affects your statutory rights under the Consumer Rights Act 2015, including your right to receive goods of satisfactory quality, fit for purpose and as described.

Information provided on or through the Services is for general informational purposes only. We do not warrant the accuracy, completeness or usefulness of such information. Reliance on such information is at your own risk.

To the fullest extent permitted by applicable UK law, the Services and all products provided through the Services are provided "as is" and "as available", without any representation, warranty or condition of any kind, whether express or implied. We do not warrant that your use of the Services will be uninterrupted, timely, secure or error-free.

SECTION 16 — LIMITATION OF LIABILITY

⚖️ Important Notice for UK Consumers: Nothing in this section limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under UK law, including under the Consumer Rights Act 2015.

To the fullest extent permitted by applicable UK law, CSUCİTEO, our partners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors shall not be liable for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages of any kind arising from your use of the Services or any products procured through the Services.

SECTION 17 — INDEMNIFICATION

You agree to indemnify, defend and hold harmless CSUCİTEO, Shopify and our affiliates, partners, directors, officers, employees, agents, contractors, licensors and service providers from and against any losses, damages, liabilities or claims, including reasonable legal fees, arising from: (1) your breach of these Terms of Service or any documents incorporated by reference; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.

SECTION 18 — SEVERABILITY

If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such a determination shall not affect the validity and enforceability of any remaining provisions.

SECTION 19 — WAIVER & ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms of Service, together with all policies and operating rules published by us on the Services, constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding all prior or contemporaneous agreements, communications and proposals, whether oral or written.

SECTION 20 — ASSIGNMENT

You may not assign, transfer or sub-licence any of your rights or obligations under this Agreement without our prior written consent, and any such attempt shall be void. We may assign, transfer or sub-licence our rights and obligations without your consent or notice.

SECTION 21 — GOVERNING LAW

⚖️ These Terms of Service and any separate agreements pursuant to which we provide you with Services shall be governed by and construed in accordance with the laws of England and Wales.
